Duterte Arrest: Atty. Salvador Panelo Speaks Out on ICC Warrant

Former chief presidential legal counsel Atty. Salvador Panelo has condemned the Duterte arrest, calling it “unlawful” and a violation of his legal rights.

In a statement, Panelo accused the Philippine National Police (PNP) of blocking one of Duterte’s lawyers from meeting him at the airport. This action raised serious concerns about the legal basis for the Duterte arrest.

“They denied him legal representation at the time of his arrest. The PNP failed to present a hard copy of the warrant. By preventing his lawyer from meeting him, the arresting officers avoided questions about the warrant’s authenticity,” Panelo argued.

ICC’s Jurisdiction Over Duterte Arrest in Question

Panelo emphasized that the International Criminal Court (ICC) has no legal authority over the Philippines.

“This arrest is illegal because the ICC has no jurisdiction over the country. The Philippines withdrew from the Rome Statute in 2019, making its rulings non-binding,” he stated.

Possible Criminal Liability for Duterte Arresting Officials

The former presidential counsel warned that government officials responsible for the Duterte arrest could face criminal charges. “This sets a dangerous precedent, as public officials can be held liable for enforcing an unlawful order,” he added.

The ICC Case and Duterte’s War on Drugs

The ICC has been investigating Duterte and other officials for alleged crimes against humanity linked to his controversial war on drugs. Police records show that around 6,000 individuals died in anti-drug operations. However, human rights groups estimate the actual number could be as high as 30,000, including vigilante killings.

I will not run or hide. I will face the charges as a lawyer, and I will not seek refuge in another country,” Duterte declared.
