Detention Key to Justice, ICC Told on Duterte

MANILA, Philippines — The International Criminal Court (ICC) has been urged to reject former President Rodrigo Duterte’s plea for interim release. Victims’ legal representatives say releasing Duterte would put witnesses in danger and disrupt justice in the drug war case.

In an 18-page statement filed on June 25, the Office of Public Counsel for Victims (OPCV) strongly opposed Duterte’s request. The OPCV said the former president has already seen key evidence and learned the identities of some witnesses, making his release a threat.

“Letting Duterte out would destabilize the country and endanger victims who bravely came forward,” the OPCV said.

Detention- Evidence Access Raises Red Flags

The ICC has shared at least seven batches of evidence with Duterte’s defense. The latest was released (with redactions) on June 4. This disclosure, according to OPCV, makes it easier for Duterte to interfere.

Duterte now knows which witnesses are helping prosecutors. With that knowledge, he or his allies could intimidate, harass, or silence them. The OPCV warned that Duterte’s release could seriously affect the case.

“He can obstruct or sabotage the trial, especially with more evidence coming in,” the OPCV noted.

Detention-Political Power Still Intact

Despite being in detention, Duterte remains politically strong. He won as mayor of Davao City in the recent elections. His children still hold major positions:

  • Sara Duterte – Vice President
  • Sebastian Duterte – Incoming Davao City Vice Mayor
  • Paolo Duterte – Reelected Representative

The OPCV said these connections give Duterte access to loyal supporters and powerful networks. This increases the risk that he might flee or influence the proceedings from outside.

“Even with restrictions, Duterte might abscond or use his influence to interfere,” the OPCV added.

Victims’ Safety Comes First

Many victims only recently found the courage to speak. Some fear threats or public shaming. Releasing Duterte now would undo the progress made and scare others into silence.

The Office of the Prosecutor (OTP) also opposed the release earlier this week. Both OPCV and OTP agree: the best way to secure Duterte’s attendance at the Sept. 23 confirmation hearing is to keep him in ICC custody.
